Update on 65 Ward Street – Motion for Leave to Appeal Dismissed
The Municipality of Port Hope is providing an update regarding the ongoing matter concerning 65 Ward Street.
In November 2024, the Municipality provided an update regarding the Motion for Leave to Appeal filed by Southbridge, which was scheduled for review by a panel of the court. In December 2024, the panel dismissed the Motion for Leave to Appeal on jurisdictional grounds, meaning the court determined it did not have the legal authority to hear the case or address the matter under appeal. The decision provided by the panel of justices reviewing the matter also awarded the Municipality $5,000 in costs.
The Municipality is working with legal counsel to assess the next steps. If no further appeals are filed, the Ontario Land Tribunal (OLT) hearing, which was temporarily paused, will resume. Dates have not been determined for the hearing to resume.
The Municipality’s legal team is operating under existing instructions from Council and is prepared to address any new developments, as needed.
The Municipality will continue to keep the community informed on the 65 Ward Street matter by providing updates as new information becomes available.
