Notice of Complete Application and Public Meeting - 5th Line
Take notice that the Council of the Corporation of the Municipality of Port Hope hereby considers an application to amend Zoning By-law 20/2010, as amended, submitted by Clark Consulting Services on behalf of the owners Donna Marie Brown and Deon Gillispie (Part 1); and Donna Marie Brown (Part 2) for lands located on the north side of 5th Line, east of County Road 65 (see Figure 1: Subject Lands Map), to be a Complete Application in accordance with Section 34 (10.7) of the Planning Act. Furthermore, the Council of the Corporation of the Municipality of Port Hope will hold a Public Meeting on Tuesday, February 25, 2020 at 6:30 p.m. at the Town Hall, 56 Queen Street, to consider the proposed application (File # ZB05-2019).
The subject lands consist of 2 separate lots legally described as follows:
• Part Lot 25 Concession 5, Part 1 of 39R9361 (referred to as ‘Part 1’) and
• Part Lot 25 Concession 5, Part 2 of 39R9361 (referred to as ‘Part 2’)
Both lots were created in 2000 by Farm Credit Canada, a Federal Crown Corporation, and not by consent application.
Currently the subject lands are designated ‘Prime Agriculture’ with a ‘Natural Environment’ and ‘Floodplain’ overlay by the Municipality of Port Hope Official Plan. The lands are also zoned Agriculture Exception 1 ‘A(1)’ Zone with an Environmental Protection ‘EP-F’ Overlay by Zoning By-law 20/2010, as amended.
The current Agriculture Exception 1 ‘A(1)’ Zone prohibits construction of a dwelling unit and was put in place as a condition of Consent Application B8/83 in 1983. This Consent created the lot municipally known as 1940 5th Line. The remaining lands, inclusive of those subject to this rezoning application, were rezoned to prohibit dwelling units.
The purpose of this Zoning By-law Amendment is to rezone the subject lands from Agriculture Exception 1 ‘A(1)’ Zone to Agriculture Exception 125 ‘A(125)’ Zone to allow for the construction of a dwelling unit on each lot and recognize the reduced lot area and lot frontage. Construction plans have not been submitted at this time.
If a person or public body would otherwise have an ability to appeal the decision of Municipality of Port Hope to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Municipality of Port Hope before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at the public meeting, to be held at a later date, or make written submissions to the Municipality of Port Hope in respect of the proposed zoning by-law amendment before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Appeal Planning Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
If you wish to be notified of the decision of the Municipality of Port Hope on the proposed Zoning By-law Amendment, you must make a written request to the Municipality of Port Hope at the address of 56 Queen Street, Port Hope, ON L1A 3Z9.
Additional information and material about the proposed Zoning By-law Amendment (File: ZB05-2019) will be available to the public for inspection between 8:30 a.m. and 4:30 p.m., Monday to Friday, at the Municipal Development Team Office at 5 Mill Street South, Port Hope.
