Complete Application and Public Meeting - 3290 Lakeshore Road
TAKE NOTICE that the Council of the Corporation of the Municipality of Port Hope hereby considers an application to amend Zoning By-law 20/2010, as amended, submitted by Spencer Hutchison of RFA Planning Consultant Inc., on behalf of the owner Donald Nichols for lands in Part of Lot 23, Concession 1, municipally known as 3290 Lakeshore Road, in the Rural Area of the Municipality of Port Hope, to be a Complete Application in accordance with Section 34 (10.7) of the Planning Act. Furthermore, the Council of the Corporation of the Municipality of Port Hope will hold a Public Meeting on Thursday, November 12, 2020 at 6:30 p.m. to consider the proposed application (File # ZB03-2020). Currently the subject lands are designated ‘Prime Agricultural,’ ‘Natural Environment,’ and ‘Floodplain’ in the Municipality of Port Hope Official Plan and zoned as Agriculture ‘A’ Zone with an Environmental Protection – Floodplain ‘EP-F’ Overlay Zone by Zoning By-law 20/2010, as amended.
THE PURPOSE of the Zoning By-law amendment is to satisfy a condition of provisional Consent with respect to File B14/19. The applicant to proposing to rezone the proposed severed lot from Agricultural ‘A’ Zone to Rural Residential ‘RESR’ Zone to reflect the existing residential use. Additionally, the retained lands will be rezoned from Agricultural ‘A’ Zone to Agricultural Exception 1 ‘A(1)’ Zone in order to prohibit construction of a dwelling.
ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of, or in opposition to the proposed Zoning By-law amendment. Should you be unable to attend the Public Meeting, your written submission will be received at the address given below up until the time of the Public Meeting. Additional information and instructions on how to participate in the public meeting are on page 3 & 4 of this notice.
If a person or public body would otherwise have an ability to appeal the decision of Municipality of Port Hope to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Municipality of Port Hope before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at the public meeting, to be held at a later date, or make written submissions to the Municipality of Port Hope in respect of the proposed zoning by-law amendment before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Appeal Planning Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
If you wish to be notified of the decision of the Municipality of Port Hope on the proposed Zoning By-law Amendment, you must make a written request to the Municipality of Port Hope at the address of 56 Queen Street, Port Hope, ON L1A 3Z9.
Additional information and material about the proposed Zoning By-law Amendment (File: ZB03-2020) will be available to the public for inspection by appointment between 8:30 a.m. and 4:30 p.m., Monday to Friday, at the Municipal Development Team Office at 5 Mill Street South, Port Hope.
