Notice of Complete Application and Public Meeting Concerning a Proposed Zoning By-Law Amendment (ZB06-2017)
TAKE NOTICE that the Council of the Corporation of the Municipality of Port Hope hereby considers an application to amend Zoning By-law 20/2010, as amended, under Section 34 of the Planning Act, submitted by Clark Consulting Services on behalf of Tova White for a portion of lands located on Part 5 of Plan 9R-347, Part 1, 2, 3, and 4 of Plan 3R-347, municipally known as 22 King Street, to be a Complete Application in accordance with Section 34 (10.7) of the Planning Act. Furthermore, the Council of the Corporation of the Municipality of Port Hope will hold a Public Meeting on Wednesday, November 1st, 2017 at 6:30 p.m. at the Town Hall, 56 Queen Street, to consider the proposed application.
The subject lands are located on the west side of King Street and to the south of Shaw Street, in the Urban Area of the Municipality of Port Hope (see Subject Lands Map).
The subject land is currently designated “Low Density Residential” and “Physical Constraint Area” by the Municipality of Port Hope Official Plan and is zoned as Low Density Residential One Type Two “RES1-2” Zone by Zoning By-Law 20/2010, as amended. A single-detached residential dwelling and an accessory building with an attached garage are located on the subject land.
The applicant is proposing to convert the existing accessory building into an accessory dwelling unit (secondary unit). No external alterations to the accessory building are being proposed. According to current zoning policies, human habitation is not permitted in accessory buildings or structures.
The purpose of the Zoning By-law Amendment would be to rezone the subject lands from Low Density Residential One Type Two ‘RES1-2’ to Low Density Residential One Type Two Exception No. 114 ‘RES1-2(114)’ in order to permit the conversion of the accessory building to an accessory dwelling unit and to recognize the existing non-complying height of the accessory building.
ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of, or in opposition to the proposed Zoning By-law amendment. Should you be unable to attend the Public Meeting, your written submission will be received at the address given below up until the time of the Public Meeting.
If you wish to be notified of the decision of the Municipality of Port Hope on the proposed Zoning By-law Amendment, you must make a written request to the Municipality of Port Hope at the address of 56 Queen Street, Port Hope, ON L1A 3Z9.
If a person or public body does not make oral submissions at the public meeting, or make written submissions to the Municipality of Port Hope before the by-law is passed, the person or public body is not entitled to appeal the decision of Council of the Municipality of Port Hope to the Ontario Municipal Board.
If a person or public body does not make oral submissions at the public meeting, or make written submissions to the Municipality of Port Hope before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.
Additional information and material about the proposed Zoning By-law Amendment (File: ZB06-2017) will be available to the public for inspection between 8:30 a.m. and 4:30 p.m. at the Municipal Development Team Office at 5 Mill Street South, Port Hope.
